City Watch — Ormond Beach
Pending STR legislation and regulatory rating tracking for Ormond Beach.
- transient lodging (<6-month lease) is not a permitted/conditional/special-exception use in any residential zoning district (city FAQ + Land Development Code)
- STRs allowed only in B-4/B-6/B-7 commercial districts, subject to local business tax receipt + state compliance
- express transient-lodging prohibition traces to post-2011 ordinances (Ord. 2013-13; updated Ord. 2022-15) — determining question is whether the residential-district exclusion predates 2011-06-01
- no numeric cap/quota device located

“CONFIRMED AT PRIMARY (Municode): §2-14 (R-2.5 Single-Family Low-Medium Density) — 'Use of dwelling units for transient lodging is prohibited in order to protect and maintain the residential character of the zoning district' — section codifier history reads '(Ord. No. 2013-11, § 1, 2-5-2013; Ord. No. 2013-13, § 7, 2-5-2013)'; companion R-2 district carries Ord. No. 2013-13, § 6 (2-5-2013), Am. Ord. No. 2022-15 (6-7-2022). No pre-2011 predecessor ordinance appears in the operative section's history. The residential transient-lodging exclusion therefore originates POST-2011-06-01 and is preempted/unenforceable under Fla. Stat. §509.032(7)(b) — not a grandfathered supply device.”— Land Development Code Ch. 2, Art. II district regulations; residential-district clause 'Use of dwelling units for
Active litigation / open question
Volusia County's 2004 ordinance prohibiting residential transient rentals (<30 days) in unincorporated areas was challenged and upheld by a Volusia County judge in December 2022. Applies to unincorporated county, not to Ormond Beach city limits, but is persuasive on FL grandfathering of pre-2011 residential-zoning STR exclusions. Source ↗

City Watch tracks changes from public sources (council agendas, state bills, local news) as coverage is activated for this market — not a complete legal compendium.
A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.
City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
