Short-term rental rules in Mesilla, NM
How Mesilla regulates short-term rentals: the rules that apply, their sources, and pending changes.
Short-term rentals here are subject to registration, a lodging tax, or a small number of operating rules.
- Town of Mesilla levies its own municipal lodgers' tax reaching lodging in town (Ch. 3.20)
- No STR-specific registration or permit process in the town code
- No cap, quota, or primary-residence requirement on general housing stock
- Zoning is silent on short-term rental (no residential-zone STR exclusion); B&B inns are a narrow owner-occupied special use, not a general-stock supply device
Based on: Mesilla Town Code Ch. 3.20 LODGERS' TAX (municipal lodgers' tax levied by the Town); zoning Title 17/18
Summary of the rule
Mesilla Town Code Ch. 3.20 'LODGERS' TAX' is a municipal lodgers' tax levied by the Town. §3.20.090 Licensing (verbatim): 'A. No vendor shall engage in the business of providing lodging in the town of Mesilla who has not first obtained a license as provided in this section... C. The town clerk-treasurer shall review applications for licenses within 10 days of receipt thereof and grant the license in due course if the clerk-treasurer finds the applicant is doing business subject to the occupancy tax.' The tax/vendor-license reaches the business of providing lodging in town (no room-count floor in the operative text); tracking the NM Lodgers' Tax Act (SB 106, 2019) it reaches whole-home/vacation-rental STR stays. This is the town's own municipal lodging-tax device.

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.
A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.
City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
