Short-term rental rules in Southern Shores, NC
How Southern Shores regulates short-term rentals: the rules that apply, their sources, and pending changes.
Short-term rentals here are subject to registration, a lodging tax, or a small number of operating rules.
- Southern Shores Zoning (Ch. 36, Art. VII): 'vacation cottages' are permitted by right alongside detached single-family dwellings in every residential district (RS-1 Sec. 36-202(b)(1); RS-10 Sec. 36-204(b)(1); R-1 Sec. 36-205(b)(1); dwellings in RS-8 Sec. 36-203(b)). STRs are not excluded from residential zones and there is no density cap or minimum-stay.
- The only STR-specific device is a durable dimensional/occupancy limit tied to health/septic: a single-family residence used as a vacation cottage 'shall not be advertised to accommodate, designed for, constructed for or actually occupied by more than 14 overnight occupants' and shall not have septic capacity for more than 14. This is a thin, Schroeder-surviving zoning layer (max-occupancy/dimensional), not a supply cap, exclusion, or registration.
- Contrast hook: 'Bed and breakfasts' are prohibited in ALL districts (Sec. 36-209(a)(4)) — a commercial-lodging prohibition, not a whole-house STR/vacation-cottage restriction; whole-house vacation cottages remain by-right. Net of the state Schroeder / § 160A-424(c) / § 160D-1207(c) lens (no surviving registration/cap device beyond the durable occupancy limit): Light-touch.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.
City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice.
