Light-touch · low intensityhigh confidence

Short-term rentals here are subject to registration, a lodging tax, or a small number of operating rules.

  • Short-term rental is a defined, enumerated Residential use permitted by-right (P) in every developed zoning district townwide (UDO Section 6.6, Table of Uses and Activities) — no zoning-district exclusion of transient/STR use, so no durable Restrictive land-use device.
  • No STR registration or permit PROCESS currently exists: the former annual $25 registration program (Code of Ordinances Ch. 12, Art. VIII, § 12-252; adopted Ord. No. 19-04-006, Apr. 3, 2019, with $25 fee + civil penalties) was REPEALED by Ord. No. 23-05-015, Art. III, Pt. I, adopted May 3, 2023; § 12-252 is now Reserved. No supply cap, no density/separation limit, no discretionary approval for whole-house rentals.
  • The surviving STR-specific layer is thin and definitional: STR is a distinct named use type (whole-house and partial-house) with a partial-house use standard (max two guest rooms, subordinate and incidental to the principal residential use; UDO Appendix A.4 / Code § 12-251) and a supplemental-regulation flag (PR) in one district. No process, cap, or exclusion.
  • Rubric net: NOT Regulated (Regulated requires an STR-specific process regime such as registration/permit — none exists after the 2023 repeal); NOT Unrestricted (STR is specifically defined and carries a thin STR-specific use standard, not merely generally-applicable law). A thin STR-specific layer over an otherwise permitted, no-cap use = Light-touch.
  • Dare County 6% occupancy tax applies (general/process — does not move the rating).

Active litigation / open question

Schroeder v. City of Wilmington, N.C. Ct. App. (2021) — Statewide NC precedent — struck a municipal STR registration + density cap as beyond municipal zoning/regulatory authority. Descriptive context only for the rating: Nags Head repealed its own STR registration ordinance (§ 12-252) in 2023, so the tier no longer turns on any Schroeder enforceability inference — it rests on the current ordinance (STR permitted by-right townwide, thin definitional partial-house standard, no process/cap/exclusion). No Nags-Head-specific STR litigation found. Source ↗

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
