Restrictivehigh confidence

Rules here limit which homes may operate as short-term rentals, how many, where, or for how many nights a year.

  • Residential-zone exclusion — daily/weekly whole-home rental is classified as 'Lodging', not a residential use, and barred from all standard residential districts (R0-R3)
  • Whole-home STR confined to mixed-use, commercial, and the R4 seasonal/short-term district only; no by-right STR use in any standard residential zone
  • No municipal STR permit path available (NC G.S. 160D-1207 / Schroeder v. Wilmington bar a town STR registration or rental permit)
  • No per-operator or citywide numeric cap; the foreclosure is by use-classification

Based on: Town of Maggie Valley UDO (Title XV, Land Usage), 151.07 Table of Permitted Uses - Use Categories; adopted 2022

Summary of the rule

Use Table 'Lodging' rows: 'Bed and Breakfast Inns' and 'Hotels, Motels, and Inns' show '-' (not permitted) in Rural (R0), Density (R1), Density (R2), Density (R3), and Short Term (R4) residential columns; permitted (P) only in the Mixed-Use and Commercial districts (Hotels = 'S' in the Farm/MU2 column). Residential districts permit 'Single Family Dwelling Unit' (P) i.e. long-term RESIDENTIAL use only.

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
