Short-term rental rules in Boone, NC
How Boone regulates short-term rentals: the rules that apply, their sources, and pending changes.
Rules here limit which homes may operate as short-term rentals, how many, where, or for how many nights a year.
- Whole-home 'vacation rentals' are EXCLUDED from every residential zoning district and permitted only in commercial/manufacturing districts (B1DC, B1DI, B2, B3) — a durable land-use district exclusion that survives Schroeder.
- In residential districts only 'homestay' rentals are allowed: lease of up to two bedrooms by a FULL-TIME resident who must be present the entire time lodgers stay (owner-present, hosted-only).
- Annual zoning permit required for both homestay and vacation rental operators (permit renewed yearly; application fee $530), framed as a zoning permit tied to district classification rather than a standalone registration lottery.
- Existing homeowners retain only a narrow safety valve — the entire house may be rented for up to two weeks per year.
Based on: Town of Boone Unified Development Ordinance (UDO) Sec. 15.14 (Vacation Rentals) and Sec. 15.05 (Homestay Rentals)
Summary of the rule
Whole-home vacation rentals excluded from all residential zoning districts; permitted only in B1DC, B1DI, B2, B3 (commercial/manufacturing) districts under UDO Sec. 15.14.

Active litigation / open question
Schroeder v. City of Wilmington, 2022-NCCOA-210 (N.C. Ct. App. 2022) — Struck Wilmington's STR registration requirement and density/lottery cap as beyond municipal authority, but expressly held cities MAY impose general zoning and development standards on STRs. This is the controlling NC lens; Boone's district-based zoning treatment is the type of measure the court left standing. Source ↗

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.
A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.
City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
