Short-term rentals here are subject to registration, a lodging tax, or a small number of operating rules.

  • Avon is an UNINCORPORATED village on Hatteras Island; there is no town government — the Dare County Zoning Ordinance and Dare County government govern land use.
  • Vacation/short-term rental IS the housing economy of unincorporated Hatteras Island and is a permitted residential use of dwellings townwide; ~27,000 rental properties countywide.
  • No STR-specific zoning-district exclusion, minimum-stay, permit, or cap found for unincorporated Dare County standard dwellings.
  • The only STR-adjacent restrictions in the ordinance are affirmative carve-outs on special/affordable programs (ADUs, Workforce Housing Units, cluster homes must be LONG-term) — which confirm STR is the default permitted use of ordinary dwellings.
  • Only general instrument is the county 6% occupancy (room) tax on gross receipts — a tax-remittance registration, not an STR permit/supply device; general/process, does not move the rating.
  • NC/Schroeder lens: NC cities generally cannot register or cap STRs absent express authority; here there is not even a registration scheme to net out — nothing durable restricts supply.

Based on: Dare County Zoning Ordinance Appendix A Ch. 22 (§22-2) — STR permitted as a residential dwelling use

Summary of the rule

Avon is an UNINCORPORATED Dare County village (CDP); the governing jurisdiction is Dare County. Dare County levies a 6% room-occupancy tax on gross receipts from rentals of rooms/lodging/cottages/private residences rented to transients (exempt if rented <15 days/yr or for 90+ continuous days), i.e. it reaches STR stays. Authorized by SL 1985-826 (as amended); collected by the Dare County Tax Collector.

Schroeder v. City of Wilmington (N.C. Court of Appeals (2021)) — City's STR registration + density cap (2% / 400–500 ft separation) struck as beyond municipal zoning/regulatory authority; NC municipalities generally cannot require STR registration or cap STR numbers absent express legislative authority. City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
