Rules here limit which homes may operate as short-term rentals, how many, where, or for how many nights a year.

  • Whole-home STR ('Tourist Home') requires a discretionary Major Development Permit as a special use in the core urban residential districts (LDRD, MDRD)
  • Not a by-right permitted use in the town's residential neighborhoods — residential-zone exclusion of by-right whole-home STR
  • Permitted by-right only in outlying estate/resort development districts (ARED 10.0-acre, Georgetown Lake, Spring Hill)
  • No municipal lodging tax (consolidated pop. ~9,400 exceeds MCA 7-6-1501 resort-tax thresholds); only the state 8% lodging tax applies

Based on: Anaconda-Deer Lodge County Code of Ordinances (Municode; codified through Ord. No. 281, 2025-06-03; Supp. 17). Land use

Summary of the rule

ADLC Code Ch. 24 use tables. LDRD §24-72 Permitted Uses (subject to ADP): '(1) Single-family Dwelling Units, including Class A Manufactured Homes. (2) Residential Accessory Structures. (3) Day Care Homes. (4) Home Occupations.' — Tourist Home NOT listed. LDRD §24-73 Special Uses (subject to a MDP): '(1) Tourist Homes...'. MDRD §24-82 Permitted Uses (ADP): single-family, two-family, accessory structures, day care — Tourist Home NOT listed. MDRD §24-83 Special Uses (MDP): '(1) Tourist Homes...'. Tourist Home is a permitted by-right use only in outlying districts (ARED 10.0 §24-62(3)(b); Georgetown Lake §24-212(2) 'Tourist Homes which are [limited to one Dwelling Unit]'; Spring Hill §24-222(3) 'Tourist Homes which are limited to one Dwelling Unit or one portion thereof'). Whole-home STR in the core urban residential neighborhoods is thus available only via a discretionary Major Development Permit (special use), not by-right = residential-zone supply device (CUP-only).

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
