Summary of the rule

Chapter 114 (Zoning), Article V, Division 2 (R-1, R-2 Residential District), Sec. 114-221(b) Permitted uses — sourced to Ord. No. 96-549, § 1(3.01.01), adopted 1996-02-16 (pre-dates the 2011-06-01 FL Stat §509.032(7)(b) grandfather cutoff), as amended by Ord. Nos. 09-699 (2009), 10-714 (2010), 12-740 (2012), 12-742 (2012) — lists permitted uses in the R-1/R-2 residential district as: single-family detached dwellings; licensed group homes/foster care (≤6 clients); mobile homes (FEMA A zones only); community residential homes (≤6 clients); and two-family dwellings existing prior to 2009-04-01. Dwelling-use classification is not conditioned on rental duration or tenancy type, and no vacation-rental-specific prohibition, moratorium, or duration/frequency restriction appears anywhere in the currently codified Ch.114. Ch.108 Sec. 108-1 (Ord. 15-807, 2015-11-19) states directly: 'This chapter does not prohibit vacation rentals, or the duration or frequency of vacation rentals, nor is it the intention of the City of Anna Maria to do so,' and Sec. 108-2(3): 'Certain vacation rentals are presently located within the single family and two-family dwelling residential zoning districts of the City of Anna Maria.' No zoning-based vacation-rental supply restriction is codified; vacation rentals in Anna Maria are governed by the Ch.108 registration, inspection and occupancy-formula process.

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
