Short-term rental rules in Nederland, CO
How Nederland regulates short-term rentals: the rules that apply, their sources, and pending changes.
Rules here limit which homes may operate as short-term rentals, how many, where, or for how many nights a year.
- Hard citywide cap of 70 total STR licenses (waitlist once reached)
- Primary-residence-only: STR licensee must be a primary resident (except Class C)
- Residential-zone exclusion: non-primary whole-home STR allowed only in CBD/General Commercial zones (Class C)
- One STR license of any type per person (per-owner limit)
Based on: Nederland Municipal Code Ch. 6, Art. V (Short-term Rental Licensing), §§ 6-91 to 6-103; established by Ord. No. 798
Summary of the rule
§6-94(a) (current codified, Ord. No. 860 §4, adopted May 18, 2024): 'There shall be a limit on the total number of short-term rental licenses that are licensed. The maximum number of licenses of any type that shall be issued is seventy (70) total licenses.' (b): 'If the maximum number of licenses has been reached, any subsequent application shall be placed on a waiting list until such time that the total number of short-term rentals falls below seventy (70) total licenses.' Editor's note: Ord. No. 860 §4 repealed the former §6-94 ('Primary residence short-term rental license') and enacted this cap. HARD CITYWIDE QUOTA in force.

Active litigation / open question
Nederland property owners sued in 2024 to block the 2024 STR ordinance (Ord. 860), which requires primary residence and sets a townwide STR cap. The town's enacted 2019/2020 Ord. 798 regime (Class B closed, Class C limited to commercial zones, primary-residence-only licensing) applies independently of that suit. Source ↗

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.
A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.
City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
