  • hard citywide cap of 165 total active STR licenses
  • cap forecloses new whole-home/non-resident STRs while count is at maximum
  • only resident-occupied single-unit parcels exempt from the cap
  • one STR license per parcel; two non-resident-occupied units per parcel prohibited

Based on: Leadville Municipal Code Title 5, Chapter 5.12 (Short-Term Rentals); maximum-number cap amended by Ord. No. 2 Series

Summary of the rule

Leadville Municipal Code §5.12.090(K) (codified, verbatim): 'There shall be a maximum of one hundred and sixty-five (165) total active short-term rental licenses in the city at any given time. Resident-occupied licenses issued to a single-unit parcel with only one active license shall be exempt from the license cap. Class 1 licenses issued to a parcel with only one (1) active license shall be exempt from the license cap. Licenses issued for owner-occupied parcels with two (2) or more short-term rental units on a single parcel shall count as one (1) license toward the license cap...' §5.12.090(L) further caps licenses at one per parcel and prohibits operation of two non-resident-occupied STR units on a single parcel. NOTE: the prior class-of-license section §5.12.050 was REPEALED by Ord. No. 2024-5 §3 (9-17-24); the in-force cap is now a hard TOTAL citywide cap of 165 active STR licenses (not a Class-2-only cap), with an exemption only for resident-occupied single-unit parcels.

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
