  • Governing jurisdiction (Baldwin County) levies a lodging/transient-occupancy tax reaching STR stays in unincorporated Point Clear
  • Alabama state lodgings tax (4%) applies to transient stays under 180 days
  • Thin, non-STR-specific layer: a tax device touches STRs but there is NO STR-specific licensing/registration process
  • Baldwin County zoning permits single-family dwellings by right in residential/rural districts; no STR supply device
  • No minimum-stay, primary-residence, host-present, cap, or residential-zone STR exclusion
  • Point Clear is an unincorporated CDP with no municipal government of its own

Based on: No STR-specific local ordinance; short-term rental permitted as a residential use

Summary of the rule

Baldwin County levies a lodging (transient-occupancy) tax on the renting or furnishing of rooms, lodgings, or accommodations to transients, authorized by Code of Alabama 1975, §45-2-243.20 through 45-2-243.30 and administered by the Alabama Department of Revenue. Consistent with the state lodgings-tax base, the tax applies to accommodations furnished to transients except for periods of 180 continuous days or more. Because Point Clear is in unincorporated Baldwin County, short-term-rental stays there are within the county's (and the state's) lodging-tax jurisdiction. This is a thin, non-STR-specific tax layer touching STRs; there is NO STR-specific licensing/registration process and NO supply device.

City Watch tracks changes from public sources — council agendas, state bills, local news — not a complete legal compendium.

A city permit is not the whole picture — HOA, condominium, deed, or lease rules may be stricter.

City Watch provides good-faith summaries of publicly available information as of the review date shown. Rules, enforcement, and permit availability can change, and summaries may contain errors or omissions. Ratings describe the general regulatory environment; they do not establish whether a particular property or stay is permitted. This is general information, not legal advice. Before buying, listing, or hosting, verify applicable requirements with the responsible authorities and review any HOA, condominium, deed, or lease restrictions.
